Employee Appeal Processes
Grievance Types
As per Executive Order 1111 Disability Support and Accommodations Policy (CSU 1111), Section F Disability Support and Accommodation for Employees, Cal Poly Humboldt has adopted the following grievance procedure to address appeals specific to accommodations.
Employees should recognize that there are two (2) procedures to address disability-related complaints, depending on the nature of the complaint. Two (2) distinct policies guide the processes noted below:
- ACCOMMODATION: CSU 1111 provides that campuses shall have an interactive process for employee accommodations. In the spirit of this policy, a procedure to addresses employee concerns regarding accommodation determinations is vital. Through this process, an employee may seek a review of decisions related to a denial of a requested accommodation, failure to provide an approved accommodation, or access-related concerns at Humboldt.
- DISCRIMINATION: This procedure addresses employee complaints alleging harassment or other forms of discrimination based on disability (unrelated to access or accommodation) and all types of employee and third-party disability discrimination complaints. These complaints should be filed directly with Title IX/DHR and not through CDRC and the Student Disability Accommodation and Accessibility Grievance Procedure.
Accommodation Decisions
The most efficient way to resolve a potential concern related to accommodation, the implementation of an accommodation, or accessibility is to communicate concerns directly to the responsible Humboldt official identified as the ADA/504 Coordinator and Director of CDRC. Most concerns about accommodation and accessibility can be resolved through facilitated discussion within the interactive process at this level. If the concern is resolved to the employee’s satisfaction, no formal appeal is necessary.
If informal solutions do not resolve the employee’s concerns related to accommodation(s), an employee may appeal in writing to the AVP of Campus Resilience and Response, Cris Koczera. This appeal should clearly state the reason for the appeal and the remedy sought by the employee. The AVP will review necessary information and may interview individuals to obtain information relevant to the appeal. The AVP will, within ten (10) business days of receipt of the appeal, render a written determination that may uphold the original decision, amend it, or overturn it. The AVP’s determination will be considered the final decision of Humboldt.

Disability Discrimination Complaints by Students, Employees and Third Parties
The Cal Poly Humboldt Title IX and Discrimination, Harassment & Retaliation Prevention (Title IX/DHR) receives and reviews reports of discrimination based on disability submitted by students, employees, and third parties to determine whether the complainant was subject to discrimination as prohibited by the EML P02-01 Accommodating Individuals with Disabilities Policy and Procedures (January 2002), consistent with Sections 503 and 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990, as amended. This policy establishes that “Complaints of discrimination based on disabling status may be filed in the Office for Diversity and Compliance Programs” and requires that “Established California State University disciplinary, grievance, or other complaint procedures will serve as a mechanism for resolving formal complaints of discrimination.”
Discrimination, Harassment, & Retaliation Title IX/DHR receives reports by the Sexual Misconduct/Discrimination Referral & Report Form and website. While the online reporting form is the most efficient way to communicate relevant information, Title IX/DHR will also receive complaints by email to Title IX/DHR, by phone (707) 826-5177, or in-person by scheduled appointment. Title IX/DHR follows the complaint resolution procedures and timeframes consistent with the Policy.
